Election date case: Ruling parties request Supreme Court to form full court bench

ISLAMABAD - The coalition government on Thursday asked the Supreme Court to hear a notice on its own by Pakistan's Chief Justice Umar Atta Pandial on delaying the announcement of the election date in Punjab and Khyber Pakhtunkhwa to form a full court.

The petition was introduced by the three parties, including the PPP, Muslim League-N and JUI (F) in a joint statement read by Advocate Farooq H Naik as the nine justices resumed the automatic notice hearing today.

The People's Democratic Movement's lawyer had also asked Judge Ijaz Al-Ahsan and Judge Syed Mazhar Ali Akbar Naqvi to step down from the nine-member court to hear the case.

A 9-member Judicial Panel headed by Chief Justice of Pakistan (CJP) Umar Atta Bendial and includes Judge Ehsan, Judge Syed Mansoor Ali Shah, Judge Muneeb Akhtar, Judge Yahya Afridi, Justice Naqvi, Judge Jamal Khan Mandukhel and Judge Muhammad Ali Mazhar.  Judge Athar Minullah heard the case.

At the beginning of today's session, the Public Prosecutor told the court that he had not received a copy of the order due to the fact that all parties were not present today.

In this regard, Chief Justice Bandial noted that the purpose of today's session is to inform the relevant authorities about the automatic notification.

On this occasion, Naik appeared before the court and read the memorandum of objection of the Pakistan Peoples Party, Jewish Community (F) and Muslim League (N) against Justice Ahsan and Justice Naqvi.

The lawyer said that upon hearing the application regarding the rehabilitation of Ghulam Mahmood Dogar, the two judges gave their observations on the matter.

The lawyer also shared the memorandum read by Judge Mandukel in yesterday's hearing.

Naik said he was objecting to the inclusion of two judges in the bench "for the sake of justice, fairness and the protection of the fundamental right to a fair trial and due process as guaranteed by Article 10a".

In what question did Judge Min Allah ask the lawyer, do you feel there is a need to form a full court for the case?

"The matter of elections is public [importance] should be a full court," Naik replied, and lodged a formal appeal to the full court to hear the automatic order regarding the postponement of the elections.

In the preliminary hearing held on Thursday, the Supreme Court issued notices to the Federal Government, the Attorney General, the Election Commission, the Advocates General of the four districts and the Advocate General of the Capital Territory of Islamabad.

On February 22, Chief Justice Pandial noted the apparent delays in the elections in the two provinces as the Pakistan Tehreek-e-Insaf (PTI) had dissolved the legislature in mid-January on the orders of the party chief Imran Khan.
